These Terms of Use govern your use of the Text Your List service ("Service") operated by Crest Authority ("we," "us," or "our"). By creating an account or using the Service, you agree to these terms.
What the Service does
Text Your List is a message scheduling and automation tool. It queues messages on our servers and delivers them through a companion app running on your own computer and phone. The Service does not send messages on your behalf. All messages are sent from your own personal phone number through your device's messaging application.
Consent requirement
You must have prior express written consent before sending any commercial or marketing message to any recipient. This is not optional; it is a legal requirement under the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and similar laws. By using this Service you represent that every recipient on your list has explicitly opted in to receive messages from you.
Acceptable consent includes: a signed opt-in form, a digital opt-in checkbox at point of purchase, a web form where the recipient voluntarily provided their number and agreed to receive texts, or documented verbal consent. Purchased lists, scraped contacts, or contacts who have not affirmatively opted in do not qualify.
Your responsibilities
You are solely responsible for how you use this Service, including the content of your messages, your recipient list, and your compliance with all applicable laws. This includes but is not limited to the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and any state or local telemarketing laws that apply in your jurisdiction.
Before sending any messages, you are responsible for ensuring that you have obtained appropriate prior express written consent from all recipients. Sending unsolicited commercial messages without consent may expose you to significant legal liability. We are not your attorney, and nothing in these Terms is legal advice.
Prohibited uses
You agree not to use the Service to: send spam or unsolicited commercial messages; harass, threaten, or harm any individual; send messages that violate any law; transmit illegal content; impersonate another person or entity; or attempt to circumvent plan limits or access controls.
We reserve the right to suspend or terminate accounts that violate these terms without refund.
Opt-out compliance
If any recipient asks not to receive messages from you, you must honor that request immediately by adding their number to your suppression list within the Service. Continued messaging after an explicit opt-out request may violate the TCPA and other laws.
Carrier rates
Text Your List sends messages through your own phone and phone number. Standard carrier messaging rates apply. We do not charge carrier fees on your behalf, but your mobile carrier may charge for messages sent or received depending on your plan.
No guarantee of delivery
Text Your List queues messages and delivers them through your companion app, but we do not guarantee that any message will be delivered successfully. Delivery depends on your companion app being running, your phone being connected, carrier conditions, and other factors outside our control. We are not liable for undelivered messages.
Limitation of liability
To the maximum extent permitted by law, Text Your List and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the 30 days preceding the claim.
We are not responsible for any legal claims brought against you by third parties as a result of your use of this Service.
Cancellation
You may cancel your subscription at any time from your billing settings. Cancellation takes effect at the end of your current billing period. No refunds are issued for partial periods. Free accounts may be deleted at any time.
Modifications
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Utah County, Utah.
SMS Legal Disclaimer
Text Your List is a scheduling and automation tool only. It does not send messages itself. It queues messages and delivers them through your own device and phone number using the Messages application on your Mac or Android phone. You are solely responsible for how you use this software.
Your responsibility to comply with the law. Sending text messages to individuals without their prior express consent may violate federal and state laws, including the Telephone Consumer Protection Act (TCPA), state telemarketing laws, and other applicable regulations. Before sending any messages, you should ensure that you have obtained appropriate consent from all recipients and that your use complies with all applicable laws in your jurisdiction.
Only message people who want to hear from you. You should only send messages to individuals who have explicitly consented to receive texts from you. This includes customers who opted in, members of your organization, or contacts who have a reasonable expectation of hearing from you. Sending unsolicited commercial messages (spam) is illegal and could expose you to significant legal liability.
No liability for user actions. Text Your List and its operators assume no liability for how this software is used. By using Text Your List, you agree that you are solely responsible for the content of your messages, your recipient list, and your compliance with all applicable laws. Text Your List is not your attorney and this is not legal advice. If you have questions about compliance, consult a qualified attorney.
Honor opt-outs. If a recipient asks not to receive messages from you, you must honor that request immediately and add them to your suppression list. Continued messaging after an opt-out request may violate the law.
